إعلان عن قيام سلطة الشعب

إن الشعب العربي الليبي المجتمع في الملتقى العام للمؤتمرات الشعبية واللجان الشعبية والنقابات والاتحادات والروابط المهنية “مؤتمر الشعب العام” انطلاقا من البيان الأول للثورة ، ومن خطاب زوارة التاريخي واهتداء بمقولات الكتاب الأخضر ، وقد اطلع على توصيات المؤتمرات الشعبية وعلى الإعلان الدستوري الصادر في 2 شوال 1389 هـ ، الموافق 11 ديسمبر سنة 1969 م. وعلى قرارات وتوصيات مؤتمر الشعب العام في دور انعقاده الأول في الفترة من 4 الى 17 محرم 1396 هـ ، الموافق 5الى 18 يناير سنة 1976 م ودور انعقاده الثاني في الفترة من 21 ذي القعدة الى 2 ذي الحجة 1396 هـ ، الموافق 13 الى 24 نوفمبر 1976 م .

وهو يؤمن بما بشرت به ثورة الفاتح من سبتمبر العظيمة التي فجرها المفكر الثائر والقائد المعلم العقيد معمر القذافي على رأس حركة الضباط الأحرار الوحدويين تتويجا لجهاد الآباء والأجداد من قيام النظام الديمقراطي المباشر ويرى فيه الحل الحاسم والنهائي لمشكلة الديمقراطية .

وهو يجسد الحكم الشعبي على أرض الفاتح العظيم إقراراً لسلطة الشعب الذي لا سلطة لسواه ، يعلن تمسكه بالحرية واستعداده للدفاع عنها فوق أرضه ، وفي أي مكان من العالم ، وحمايته للمضطهدين من أجلها . ويعلن تمسكه بالاشتراكية تحقيقا لملكية الشعب ، ويعلن التزامه بتحقيق الوحدة العربية الشاملة ، ويعلن تمسكه بالقيم الروحية ضمانا للأخلاق والسلوك والآداب الإنسانية ويؤكد سير الثورة الزاحفة بقيادة المفكر الثائر والقائد المعلم العقيد معمر القذافي نحو السلطة الشعبية الكاملة وتثبيت مجتمع الشعب القائد والسيد الذي بيده السلطة وبيده الثروة وبيده السلاح، مجتمع الحرية ، وقطع الطريق نهائيا على كافة أنواع أدوات الحكم التقليدية من الفرد والعائلة والقبيلة والطائفة والطبقة والنيابة والحزب ومجموعة الأحزاب ، ويعلن استعداده لسحق أي محاولة مضادة لسلطة الشعب سحقا تاما.

إن الشعب العربي الليبي وقد استرد بالثورة زمام أمره ، وملك مقدرات يومه وغده ، مستعينا بالله متمسكا بكتابه الكريم أبدا مصدرا للهداية وشريعة للمجتمع ، يصدر هذا الإعلان إيذانا بقيام سلطة الشعب ، ويبشر شعوب الأرض بانبلاج فجر عصر الجماهير.

أولا:- يكون الاسم الرسمي لليبيا( الجماهيرية العربية الليبية الشعبية الاشتراكية ).

ثانيا:- القرأن الكريم هو شريعة المجتمع في الجماهيرية العربية الليبية الشعبية الاشتراكية .

ثالثا:- السلطة الشعبية المباشرة هي أساس النظام السياسي في الجماهيرية العربية الليبية الاشتراكية ، فالسلطة للشعب ولا سلطة لسواه ، ويمارس الشعب سلطته عن طريق المؤتمرات الشعبية واللجان الشعبية والنقابات والاتحادات والروابط المهنية ومؤتمر الشعب العام ، ويحدد القانون نظام عملها .

رابعا:- الدفاع عن الوطن مسؤولية كل مواطن ومواطنة ، وعن طريق التدريب العسكري العام يتم تدريب الشعب وتسليحه ، وينظم القانون طريقة إعداد الإطارات الحربية والتدريب العسكري العام.

The Sabha Declaration of the Establishment of the Authority of the People

The Libyan Arab people meeting in a general assembly of people's congresses and people's committees, trade unions, federations and craft associations known as the General People’s Congress;

basing themselves upon the first manifesto of the Revolution and the historic speech at Zuwara;

guided by the concepts of The Green Book;

having considered the recommendations of the popular congresses;

the constitutional proclamation issued on Shawwal 2, 1389 years After the Death of the Prophet corresponding to the 11th December 1969 years After the Birth of Christ;

as well as the resolutions and recommendation of the General People’s Congress in its first session held in the period from 4 to 17 Muharram 1396 years After the Death of the Prophet, corresponding to 5 to 18 January 1976 years After the Birth of Christ. and its second session in the period from 21 Dhu al-Qada to 2 Dhu al-Hijjah 1396 years After the Death of the Prophet, corresponding to 13 to 24 November 1976 years After the Birth of Christ;

Expressing their belief in the teachings of the great First of September (Al-Fateh) Revolution launched by the revolutionary thinker, teacher and leader, Colonel Mu'ammar Al-Qaddafi who, at the head of the movement of Free Unionist officers, gave a culmination to the struggle of our fathers and grandfathers for the creation of a regime of direct democracy, and recognizing this to be the final and decisive solution to the problem of democracy;

The Libyan Arab people, being in recognition of the sole authority of the people, the incarnation of popular rule in the land of the great Victory (Al-Fateh);

do proclaim their attachment to liberty and their readiness to defend its cause in their homeland and in any other part of the world and to protect all those who are oppressed for its sake;

do proclaim their attachment to socialism in order to achieve popular ownership;

do proclaim their commitment to the realization of total Arab unity;

do proclaim their attachment to spiritual values as a guarantee of morality and humane conduct;

do affirm the continuous march of the Revolution, led by the revolutionary thinker, leader and teacher, Colonel Mu'ammar Al-Qaddafi towards the goal of full people's power and the establishment of the community of the people as leader, master, and owner of all authority, resources and arms, a community of freedom, and towards the putting to an end forever of all types of traditional instruments of government such as the individual, the family, tribe, or sect, class, parliamentary representation, party and party groupings, and do proclaim their readiness to totally smash any attempt against the authority of the people;

The Libyan Arab people, having recovered self-mastery through the Revolution;

having gained possession of their present and future destiny;

and relying upon God and holding always fast to His Glorious Book as a source of guidance and as a Law (Sharia) for society; do hereby issue this Proclamation in which they announce the establishment of Popular Authority and joyfully proclaim to the peoples of the earth the dawn of the era of the masses:

1. The official name of Libya shall be: The Socialist People’s Libyan Arab Jamahiriya.

2. The Holy Qur'an is the Sharia (law) of society in the Socialist People’s Libyan Arab Jamahiriya.

3. Direct popular authority is the basis of the political system in the Socialist People’s Libyan Arab Jamahiriya. Authority belongs to the people and to no one lese. The people exercise authority through people's congresses, people's committees, trade unions, federations, craft associations and the General People’s Congress. Their rules of procedure shall be determined by law.

4. Defense of the homeland is the responsibility of every citizen, male and female. The people shall be trained and armed through general military training. The law shall determine the manner of promotion of the military cadres and general military training.
